The Security Council,
Recalling its previous resolutions, in particular resolutions 661 (1990) of 6 August 1990, 687 (1991) of 3 April 1991, 707 (1991) of 15 August 1991, 715 (1991) of 11 October 1991, 896 (1995) of 14 April 1995, 1051 (1996) of 27 march 1996 and 1153 (1998) of 28 February 1998,
Having held a comprehensive consideration of the reports of the three panels on Iraq (S/1999/356), established pursuant to the note by the President of the Security Council of 30 January 1999 (S/1999/100), and the presentation of these reports by Ambassador Celso L.N. Amorim, the chairman of the panels (S/1999/415),
Stressing the importance of a comprehensive approach to the full implementation of all Security Council resolutions regarding Iraq aimed at overcoming the current impasse which is characterized by continued absence of international monitoring and verification regime and the aggravating humanitarian crisis in Iraq with dire social consequences;
Recalling the goal of establishing in the Middle East a zone free from weapons of mass destruction and all missiles for their delivery and the objective of a global ban on chemical weapons in accordance with paragraph 14 of resolution 687 (1991) of the Security Council;
Reiterating the commitment of all Member States to the sovereignty, territorial integrity and political independence of Kuwait, Iraq and the neighboring states;
- Welcomes the recommendations made by the three panels;
- Notes that actions incumbent upon Iraq under paragraph 8 to 13 of resolution 687 (1991) have been completed in such a way that the Plans contemplated in paragraphs 10, 12 and 13 of resolution 687 (1991) and approved by resolution 715 (1991) must be strengthened in order to reinforce the Ongoing Monitoring and Verification mechanism and endorses the conclusion of the panel on disarmament that it is technically feasible to address, through integration, remaining unresolved disarmament issues of the Iraqi past military programs in the context of a reinforced OMV [ongoing monitoring and verification] system and that such a system is viable;
- Endorses further the conclusions of the humanitarian panel that the humanitarian situation in Iraq will continue to be a dire one in the absence of a sustained revival of the Iraqi economy, which in turn cannot be achieved solely through remedial humanitarian efforts;
- Endorses also the conclusion of the third panel regarding the need to implement fully paragraphs 2 and 3 of resolutions 686 (1991) and section "G" of resolution 687 (1991) which would require additional efforts on the part of Iraq to solve the issue of Kuwaiti and third countries missing persons and Kuwaiti property and archives and requests the Secretary-General to report appropriately every three months to the Council on the status of the Kuwaiti and third countries missing persons and every six months on the status of the Kuwaiti property and archives;
- Requests the Secretary-General to appoint a Coordinator to help him in the discharging the above-mentioned activities, and direct his Special Envoy in Iraq to facilitate the work of the coordinator and invites the International Committee of the Red Cross to keep the Secretary-General, his Special Envoy and the Coordinator apprised as appropriate of all activities undertaken in connection with facilitating the repatriation of all Kuwaiti and third country nationals or the return of their remains, present in Iraq on or after 2 August 1990,
- Expresses its intention to suspend the prohibitions against the sale or supply to Iraq of commodities or products, other than those mentioned in operative paragraph 24 of resolutions 687 (1991) and those subject to the mechanism approved by resolution 1051 (1996), as well as the prohibitions against the import of commodities or products originating in Iraq, including the use of air and maritime transport for the delivery of such goods, and prohibitions against all financial transactions related thereto, contained in resolution 661 (1990) for an initial period of one hundred days, upon receipt of the report of the Secretary-General that the reinforced OMV system in Iraq has become effectively and efficiently operational;
- Requests that after the approval by the Council of the report referred to in paragraph 12 below, the Secretary-General submit every thirty days to the Security Council for its review a report as to whether the reinforced OMV system in Iraq is effectively and efficiently operational;
- Decides that after every suspension period of one hundred days and upon receipt of the report of the Secretary-General that the reinforced OMV system in Iraq is still effectively and efficiently operational, the suspension of measures referred to in paragraph 6 above shall continue for a further period of one hundred days unless the Council decides to the contrary;
- Decides also that if at any time the Secretary-General reports that the reinforced OMV system is not effectively and efficiently operational, the suspension of the measures referred to in paragraph 6 above shall terminate on the fifth working day following the report of the Secretary-General, unless the Security Council decides to the contrary;
- Further decides that, notwithstanding paragraph 6 above, Iraqi assets, with the exception of those acquired after the suspension of the prohibitions mentioned in paragraph 6, shall remain frozen;
- Expresses its intention to unfreeze the Iraqi assets mentioned in paragraph 10 above upon receipt of the report of the Secretary-General ascertaining that the requirements to Iraq under paragraphs 2 and 3 of resolution 686 (1991) and section "G" of resolution 687 (1991) have been satisfactorily fulfilled;
- Requests the Secretary-General to present within sixty days of the adoption of this resolution, taking into account the recommendations of the First Panel of experts, proposals to be submitted to the Council for approval regarding a mechanism to reinforce the Plan approved by resolution 715 (1991) as well as the mechanism approved by resolution 1051 (1996) in order to secure Iraqi compliance with the provisions prohibiting the acquisition or the development by Iraq of items specified in paragraphs 8 and 12 of resolution 687 (1991) as well as with the provisions regarding the items subject to the mechanism approved by resolution 1051 (1996) including proposals concerning a structure to carry out relevant activities and financial modalities that will guarantee full and efficient implementation of prohibitions referred to in Paragraph 24 of resolution 687 (1991) and those related to goods subject to import/export mechanism approved by resolution 1051, without prejudice to the suspension of prohibitions referred to in paragraph 6 above;
- Expresses its full support to the Secretary-General in his efforts to ensure full implementation of the Memorandum of Understanding of 21 February, 1998 and to enable the resumption of a normal relationship between the United Nations and Iraq;
- Decides in accordance with its responsibility under the Charter, to remain actively seized of the matter, in order to ensure implementation of this resolution, and to secure peace and security in the region.
